These Terms of Service explain your rights and obligations when using our website, purchasing our creations, and accessing our related services. Please read these terms carefully before placing an order.

1. Operator and Scope of Application

This website is operated by Jade Family Jewelry Co., Ltd. These Terms of Service apply to purchases and related services conducted through this website. Transactions made at our physical boutiques or through other sales channels are subject to the terms agreed upon for each transaction and applicable laws and regulations.

This website uses the e-commerce platform provided by Shopify. JADEGIA is responsible for product transactions and after-sales services, while Shopify provides the platform and related technical services.

2. Website Use and Transaction Information

Please provide accurate and complete contact, payment, and shipping information when placing an order to ensure that your transaction can be processed properly. If any information needs to be corrected, please contact our customer service team as soon as possible.

If you use an account on our website, please keep your login credentials secure. If you discover unauthorized account access or suspect any unusual transaction activity, please notify us immediately. Upon becoming aware of such circumstances, we will suspend the relevant transaction processing and subsequent use of the affected account as appropriate, and assist in investigating the matter.

Minors entering into transactions must obtain the permission or ratification of their legal representatives, as required by applicable law.

3. Product Information and Natural Characteristics

The product name, price, materials, dimensions, specifications, included items, and other material information displayed on each product page form part of the transaction terms. Whether a certificate of authenticity or appraisal, accessories, or other services are included in the purchase price shall be determined by the individual product listing and the terms agreed upon for the transaction.

Natural jadeite is unique in its colour, texture, translucency, and mineral characteristics. We make every effort to present each creation accurately through photographs and written descriptions. However, lighting conditions during photography and individual screen settings may affect the colours displayed. If you have any questions regarding specific details, we welcome you to contact us before making a purchase.

Variations arising from the natural characteristics of jadeite or differences in colour presentation shall not exempt a product from the agreed quality and specifications, nor relieve us of our legal responsibilities for defects.

4. Orders and Formation of Contract

Before submitting an order, please carefully review the selected creation, quantity, price, payment method, shipping method, and delivery information.

Whether a contract has been formed shall be determined in accordance with the expressions of intent presented during the checkout process, the content of relevant notifications, and applicable law. Once an order has been confirmed and a contract formed, we will fulfil our obligations accordingly and will not arbitrarily change the product specifications, price, or other agreed transaction terms.

If inventory discrepancies, listing errors, or other circumstances arise that may affect fulfilment, we will contact you as soon as possible to explain the situation and seek a resolution in accordance with applicable law. Where a refund is legally required, we will arrange the refund accordingly. We will not arbitrarily cancel a contract that has already been formed solely on the grounds of incorrect website information.

5. Pricing and Payment

Product prices and transaction currencies are determined by the product page and checkout display at the time the order is placed. Shipping charges and any other necessary fees will be clearly disclosed before you confirm your transaction. No additional fees that have not been disclosed in advance and agreed to by you will be charged.

Available payment methods and their applicable conditions are specified on the checkout page. Please use only payment instruments that you are authorized to use.

Price changes and promotional adjustments apply to transactions made after the changes take effect. They do not retroactively alter the agreed terms of orders for which contracts have already been formed.

6. Shipping and Delivery

For information regarding delivery areas, shipping methods, fees, and estimated delivery times, please refer to our Shipping Policy and the information provided during checkout.

If a delivery is delayed, a shipping issue arises, or an item is damaged in transit, we will assist with the necessary enquiries and resolution. We will assume the responsibilities required under the contract and applicable law. The transfer of goods and the allocation of risk shall be governed by applicable law. We do not automatically disclaim responsibility merely because the goods have been handed over to a delivery carrier.

7. Seven-Day Cooling-Off Period and Returns and Exchanges

For online purchases, unless a statutory exception to the seven-day right to rescind applies and has been disclosed in advance, you may rescind the contract within seven days beginning on the day following receipt of the goods. You may do so by returning the goods or providing written notice. You are not required to provide a reason or bear any fees arising from the lawful exercise of this right.

You may inspect the goods to the extent reasonably necessary to determine their nature and characteristics. Opening the packaging for such necessary inspection does not, by itself, deprive you of your right to rescind the contract.

When returning an item, please package it carefully and include the original accessories, certificates, and gifts, if any, to facilitate verification.

To initiate a return, please email contact@jadegia.com with your order number, purchaser's name, contact information, and product name. The applicable deadline is determined by the date on which you exercise your right to rescind, not by the date on which customer service responds to or approves your request.

Requests for exchanges, size adjustments, or style changes will be handled according to product availability, the circumstances of the individual item, and the terms agreed upon by both parties.

Where customized services are legally exempt from the seven-day right to rescind, the applicable exemption must be clearly disclosed before the transaction. The right to return a product shall not be excluded solely because the item is jewellery or a high-value purchase.

Product defects, incorrect deliveries, and damage sustained during shipping will be handled separately in accordance with applicable law and the circumstances of each case. Such matters are not subject to the expiry of the seven-day cooling-off period.

8. Care and After-Sales Services

You are welcome to contact us regarding jadeite care, wearing advice, size adjustments, or repair services.

The availability of services, processing time, and applicable fees will be assessed according to the condition of the individual piece. Details will be explained and your consent obtained before any work begins.

After-sales services do not imply that all creations are eligible for free repairs or adjustments, or that identical warranty terms apply to every item. Individual agreements and any responsibilities required by law remain unaffected.

9. Personal Data and Brand Content

Unless otherwise indicated, the brand logos, text, photographs, videos, and other content on this website are owned by JADEGIA or the respective lawful rights holders.

Any reproduction, adaptation, or commercial use beyond what is permitted by law requires prior authorization from the relevant rights holder.

You must not use this website to engage in fraud, infringe upon the rights of others, collect personal data unlawfully, or interfere with the security or normal operation of the website.

10. Customer Service and Dispute Resolution

If you have any questions or concerns regarding an order, product, or service, please contact us first by email or telephone and provide the relevant order details and information about the issue.

We will handle complaints in accordance with applicable law and work with you to seek a reasonable resolution.

If a mutually acceptable resolution cannot be reached, you may seek assistance from a consumer service centre, a consumer dispute mediation committee, or another authority legally authorized to handle such matters.

11. Governing Law and Updates to These Terms

These Terms of Service are governed by the laws of the Republic of China (Taiwan).

Any ambiguity in these terms shall be interpreted in favour of the consumer. Nothing in these terms shall restrict any rights you are entitled to under applicable law.

The court with jurisdiction over any dispute shall be determined in accordance with applicable law. Nothing in these terms excludes statutory jurisdictional provisions under consumer protection laws or small-claims procedures.

Any updates to these Terms of Service will be published on this page. Transactions for which contracts have already been formed will remain subject to the terms agreed upon at the time of the transaction. Unless otherwise required by law or lawfully agreed upon by both parties, updates to these website terms will not alter the terms of existing contracts.
